18 U.S.C. § 2257 Compliance Statement

This statement addresses Cuffplay's position with respect to the record-keeping requirements of 18 U.S.C. § 2257 and related regulations at 28 C.F.R. Part 75 (the “2257 Regulations”).
1. Scope of the Service
Cuffplay is a text-based chat community. The Service is not designed to host, produce, display, or distribute sexually explicit visual depictions of actual sexually explicit conduct within the meaning of 18 U.S.C. § 2256(2)(A).
The Service does not permit the uploading, display, or distribution of pornographic images or video. Our Terms of Service prohibit the posting of such content, and our moderation team removes any violations promptly.
2. No Covered Content
Because the Service does not produce or distribute matter within the scope of § 2257, we are not required to and do not maintain the records described in 18 U.S.C. § 2257(a)–(c).
Written descriptions of consensual adult sexual activity, discussion of kink practices, educational content, and similar text-based material do not fall within the statutory scope of § 2257, which applies to “visual depictions” of “actual sexually explicit conduct”.
3. Age Verification
Although not required by § 2257 for a text-only service, we verify that all account holders are 18 years of age or older at signup. We do this by collecting date of birth and age-confirmation, and by reserving the right to demand additional verification at any time. Accounts found to belong to minors are terminated immediately and reported to the appropriate authorities as required by law.
4. Zero Tolerance for Child Sexual Abuse Material
Cuffplay has zero tolerance for content that sexualizes minors in any form. Reports of such content are prioritized and investigated within 24 hours. We cooperate with the National Center for Missing and Exploited Children (NCMEC), the CyberTipline, and applicable law-enforcement agencies.
